BH RAMA KRISHNA NAIK The Court made the following: 3 VS,J C.C.No.976 of 2025 ORDER: This Contempt Case is filed for willful violation of the common order passed by this Courtin W.P.No.4437 of 2019 and batch on 23.02.2024, wherein this Court passed the following interim order: “….disposed of directing the 3rdrespondent-Tahsildar, Mudenipalli Mandal, Mudenipalli, Krishna District to conduct survey in the presence of all the petitioners in all the three writ petitions. The said survey shall be completed within a period of eight (8)weeks from the date of receipt of a copy of this order and if it is found that any of them have violated the conditions enumerated under G.O.Ms.No.7 and 15, the respondents are at liberty to initiate action against them, in accordance with law.” 2. The 1st respondent has filed a detailed counter duly stating that, in pursuance of the orders passed by this Court, instructions were issued to the Mandal Surveyor, Mudinepalli to survey the lands and carry out peg marking by leaving 3 metres width for formation of seepage bodi, in accordance with the Government Orders issued in G.O.Ms.No.7, Animal Husbandry, Dairy Development and Fisheries (Fish-II) Department, dated 16.3.2013, and G.O.Ms.No.15, Animal Husbandry, Dairy Development and Fisheries (Fish) Department, dated 26.5.2015. It is further stated that the Mandal Surveyor, Mudinepalli conducted the survey in the presence of all the petitioners in the three writ petitions at 10.30 A.M. on 24.7.2024 and identified the places for peg marking for formation of 3 metres width seepage bodi. Thereafter, the Assistant Inspector of Fisheries, Mudinepalli was informed regarding 4 VS,J C.C.No.976 of 2025 completion of the survey and peg marking and was requested to take further action in the matter. It is further stated that the Assistant Inspector of Fisheries, Mudinepalli issued notice dated 16.08.2024 to Mr.Varre Sasidhar of Alluru Village directing him to rectify the fish tank in accordance with the conditions laid down in G.O.Ms.Nos.7 and 15. In the said notice, he has quoted the required distances to be maintained from villages, drinking water tanks, road margins, agricultural lands, and for formation of seepage bode where agricultural lands are abutting the fish tanks. It is further stated that the Tahsildar, Mudinepalli also issued notice dated 20.03.2005 to the fish tank owners directing them to comply with the conditions relating to formation of seepage bodi. In response there to, Mr.Varre Sasidhara Rao and Mr.Varre Girish have submitted representation dated 25.03.2025 stating that they were constructing the seepage bodi in accordance with the instructions issued by the Tahsildar, Mudinepalli and the peg marking carried out by the Mandal Surveyor on 24.7.2024. Subsequently, the neighboring ryoths i.e., Mr.VarreSasidhara Rao and Mr.Varre Girish have also formed the seepage bunds strictly maintaining a width of 3 Metres in accordance with the norms prescribed under G.O.Ms.No.7 dated 16.03.2013, and the same was confirmed by the Assistant Inspector of Fisheries, Mudinepalli through a Validation Certificate. 5 VS,J C.C.No.976 of 2025 3. In view of the above facts and circumstances, this Court is of the opinion that the respondents have complied with the common order passed by this Court in W.P.No.4437 of 2019 and batch, dated 23.02.2024. 4.
