Against the order of termination of services of the petitioner dated 09.02.2021 passed by the respondent no.4/District Basic Education Officer, Gorakhpur, petitioner filed a petition being Writ A No.5505 of 2023, which is still pending. 2. Consequent to the same an order of the recovery has been issued by the respondent no.4 on 26.10.2023, which is under challenge in the present writ petition. 3. It is argued by Sri A.K. Nagwvanshi, learned counsel for respondent that against the order of suspension Writ A No.5505 of 2023 filed by the petitioner is still pending consideration and the order of recovery passed by the respondent No.2 is only a consequential order, hence, the present petition is not maintainable. 4. At this point of time, a prayer has been made to dismiss present writ petition with liberty to file appropriate application in his pending writ petition. 5.
