Page No.# 3/3 BEFORE HONOURABLE MR. JUSTICE SANJAY KUMAR MEDHI ORDER 19.09.2025 Heard Shri A.R. Bhuyan, learned counsel for the petitioners, who are elected Ward Members of 96 Haradatta Gaon Panchayat in the Kamrup District. Their grievance is with regard to the election of the President and Vice President held on 09.07.2025. It however transpires that the petitioner no. 5 himself is one of the beneficiary of the said Election as he was elected as the Vice President. Whether a challenge instituted by 6 (six) petitioners including the petitioner no. 5 would be maintainable would be a debatable issue. At this stage, Shri S.S. Roy, learned State Counsel, Shri S. Dutta, learned Standing Counsel, P&RD and Shri H.K. Das, learned counsel for the respondent no.
5 have further informed that the same petitioners had earlier approached this Court in WP(C)/4156/2025 which was disposed of on 01.08.2025 and there is not even a whisper of the aforesaid case in the present writ petition. Shri Bhuyan, the learned counsel has tried to clarify that the issues are different. In any case, the learned counsel for the petitioners seeks leave to withdraw this writ petition with a liberty to present it afresh. Writ petition accordingly stands dismissed on withdrawal with liberty as prayed for. JUDGE Comparing Assistant
