HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - A No. - 10015 of 2025 Court No. - 18 HON'BLE SHREE PRAKASH SINGH, J. Heard learned counsel for the petitioner, Mr. Alok Saran, learned counsel for respondent nos. 2 & 3, Mr. Neerav Chitravanshi, learned counsel for respondent nos. 4 to 6, Mr. Brijendra Singh, learned Additional Chief Standing Counsel for the State and perused the records. The present petition has been filed challenging the order dated 26.06.2025 passed by the opposite party no. 2, whereby, one increment with cumulative effect has been stopped. The contention put forth by learned counsel for the petitioner is that without issuing any charge sheet and contemplating any inquiry, major punishment has been awarded to the petitioner vide impugned order dated 26.06.2025. He submitted that no major punishment can be awarded unless the proceedings provided under the Rule 7 of उǥर Šदेश पावर कॉरपोरेशन िलिमटेड कािमक (अनुशासन एवं अपील) िविनयमावली, 2020, are properly undertaken, thus, submission is that the impugned order dated 26.06.2025 is unsustainable. On the other hand, counsel appearing for the respondent corporation fairly submits that procedure of full-fledged inquiry has not been done prior to passing the order impugned. In view of the above, the impugned order dated 26.06.2025 is hereby quashed. Consequences to be followed. Versus Counsel for Petitioner(s) : Payal Singh, Abhishek Kumar Singh Counsel for Respondent(s) : C.S.C., Alok Saran, Neerav Chitravanshi Pramod Kumar .....Petitioner(s) State Of U.P. Thru. Addl. Chief Secy. / Prin. Secy. Energy Deptt. Lko And 5 Others .....Respondent(s) However, it is open for the respondent corporation to proceed in the matter afresh, if so desires. With the aforesaid observations, the writ petition is hereby allowed. November 20, 2025 Mayank WRIA No. 10015 of 2025 2 (Shree Prakash Singh,J.)
