JUSTICE SANJEEV KUMAR SHARMA ORDER Date : 15 .09. 2025 Heard Ms. T. Som, learned counsel for the petitioners and Mr. B. Sharma, learned Addl. PP for the State respondent. This application has been filed by the petitioners namely, (1) Jaynal Ali and (2) Saddam Ali under Section 483 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, seeking bail in connection with Hajo P.S. Case No. 308/2025 under Sections 21(b)/ 29 of the NDPS Act. Case diary is received and perused. This court on earlier occasions rejected the prayer for bail on behalf of the present petitioners by order dated 27.08.2025, passed in B.A. No. 2577/2025. Considering the recovery of the heroine from the accused persons, on perusal of the case diary, it appears that necessary steps in the investigation has been carried out and it is submitted by the learned Addl. PP that the case is pending for report of FSL. Perusal of the case diary shows that the last entry of the CD is made on 29.07.2025 and thereafter progress of the investigation is not known. In the meantime, the petitioners have completed 43 days in custody. Having regard to the above, the prayer for bail is allowed. Accordingly, the petitioners namely , (1) Jaynal Ali and (2) Saddam Ali shall be released on bail on furnishing a bond of Rs. 50,000/- (Rupees fifty thousand only) each with two sureties each of the like amount to the satisfaction of the learned Special Judge, Kamrup, Amingaon in connection with the aforementioned case. The direction for bail is further subject to the conditions that the accused- petitioner Nos.1 and 2- Page No.# 3/3 (1) shall not leave the territorial jurisdiction of the learned Special Judge, Kamrup Amingaon without prior written permission from him/ her. (2) shall not hamper with the investigation and tamper with the evidence of the case; and (3) shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer. In terms of the above, this bail application stands disposed of. Return the case diary. JUDGE Comparing Assistant
