Short counter affidavit filed by learned counsel for the private respondent is taken on record. 2. Heard learned counsel for the applicant, learned AGA for the State, learned counsel for the opposite party no. 2 and perused the record. 3. This application under Section 482 Cr.P.C. has been filed for quashing the summoning order dated 18.5.2024 issued by Chief Judicial Magistrate, Gonda as well as charge sheet no.1 of 2024 dated 30.4.2024 and entire criminal proceedings of Session Trial No.506 of 2024 (State vs. Vimal Kishore Gautam) arising out of Case Crime No.0233 of 2024, under Sections 376, 406, 323, 504, 506 IPC, Police Station Kotwali Nagar, district Gonda pending before the court below on the basis of compromise dated 19.09.2025 contained as annexure no. 6 to this application. 4. In pursuance of the earlier order dated 08.12.2025, the parties are present before this court and they are duly identified by their respective counsels. 5. The private respondent stated before this court that issue has already been resolved between them. They entered into the marriage and the same has already been registered before the Marriage Registrar at NCT of Delhi. The Marriage Certificate no. 90730000226724 was issued by the authority on 11.07.2025. They are enjoying their matrimonial life and she does not want to prosecute the applicant. Learned counsel for the applicant as well as private respondent submitted that as the applicant and private respondent are enjoying their matrimonial life, therefore, trial of the case in question is a futile exercise, as in the FIR, it was alleged that on the pretext of marriage, the applicant abused the private respondent. 7. Learned counsel also relied upon the decision of the Hon’ble Supreme Court in the case of Madhukar and others vs. State of Maharastra and others in Criminal Appeal No. 2957 of 2025 and requested that proceedings may be quashed. 8. Learned AGA does not dispute this fact that on the basis of document annexed with the application that issues have been resolved and the applicant as well as the private respondent solemnised their marriage. 9. Considering the submissions of learned counsel for the parties, going through the contents of the application as well as the relevant material, as the prosecution of the case in question was initiated on the basis that she was physically abused by the applicant on the pretext of marriage and thereafter she denied. As the marriage has already been solemnsied and the issue has been resolved by way of settlement/agreement between the parties dated 19.9.2025, annexed at page 74-75 relevant part of the settlement agreement are reproduced hereasunder : "सś परीWण संćया- 506/2024 मुकदमा अपराध संćया 0233/2024 अęतगăत धारा-376, 406, 323, 504, 506 आई०पी०सी० थाना- कोतवाली नगर, जनपद- गोĔडा हम उभय पW आपस मे िनĞन शतȍ के पाबęद होते हैः- 1. यह िक Šथम पW अनीता देवी पुśी चोखे लाल तथा िDZतीय पW/अिभयुǘ िवमल िकशोर गौतम के बीच िदनांक 27.10. 2021 को शारीिरक सĞबęध बन गये थे। 2. यह िक Šथम पW अनीता देवी/वािदनी DZारा एक Šथम सूचना िरपोटă िदनांक 15.04.2024 को थाना कोतवाली नगर, जनपद- गोĔडा मȅ घटना के 2 वषă 5 माह दजă करायी थी। A482 No. 10082 of 2025 2 3. यह िक उभय पWȋ ने िदनांक 10.07.2025 को आपसी सहमित से आयă समाज मिęदर िववाह बęधन Ŗĥट, 46 Ŏाउęड ěलोर, गोखले माकȆ ट तीस हजारी िदġली 110054 मȅ िववाह कर िलया है। 4. यह िक उभय पW ने िदनांक 11.07.2025 को िडिĥŖक मिजĥŖेट कोतवाली, सेęŖल िडिĥŖक िदġली मȅ रिजĥŖेशन करवा िलया है िजसका सिटिफके ट नं० 90730000226724 है। 5. यह िक उभय पW अब पित पĕनी की तरह सĞबęध िनभा रहे है और दोनो के मĘय अनजाने मे उǘ घटना घिटत हो गयी थी, जो अब िबना िकसी जोर दबाव के मुकदमा उपरोǘ मȅ समझौता करने के इċछु क है। 6. यह िक Šथम पW / वािदनी अब उपरोǘ मुकदमा नहȂ लíना चाहती है और कोई अęय साĨय इस मुकदमे मȅ नहȂ देना चाहती है। 7. यह िक िDZतीय पW एक सामािजक व सĞţाęत Dzिǘ है इनके DZारा िकसी Šकार की कोई घटना जानबूझकर कािरत नहȂ की गयी है। िलहाजा यह सुलहनामा पś दोनो पWȋ ने खूब सोच समझकर समW गवाहान ĥवĥथ िचǥ मन से अपने-अपने हĥताWर बनाकर तĥदीक िकया तािक सनद रहे और वǘ जɴरत पर काम आवे।" 10. As the issue has already been resolved, the applicant and private respondent are enjoying their matrimonial life, therefore, trial of the case in question is a futile exercise, therefore, the present application is allowed. 11. Accordingly, the summoning order dated 18.5.2024 issued by Chief Judicial Magistrate, Gonda as well as charge sheet no.1 of 2024 dated 30.4.2024 and entire criminal proceedings of Session Trial No.506 of 2024 (State vs. Vimal Kishore Gautam) arising out of Case Crime No.0233 of 2024, under Sections 376, 406, 323, 504, 506 IPC, Police Station Kotwali Nagar, district Gonda pending before the court below on the basis of compromise dated 19.09.2025 contained as Annexure No.6 to this application are hereby quashed. 12.
