It is the contention of the petitioner that the City Municipal Council, Madanayakanahalli had no jurisdiction to reject his claim on the ground that the lands were not converted. Reliance is sought to be placed on judgments of the Division Bench of this Court to indicate there is no need to seek for conversion. 3. Learned counsel appearing for the City Municipal Council however submits that the request of the petitioner was for grant of sanction to a plan to enable to him to erect a warehouse and the City Municipal Council had no jurisdiction to grant the said NOC. - 4 - NC: 2025:KHC:1583 WP No. 7617 of 2024 4. In the light of this statement, it is obvious that the endorsement issued by the City Municipal Council would be incorrect. 5. Learned counsel also submits that the Authority to grant permission to erect a warehouse is the Bengaluru-Mysuru Infrastructure Corridor Area Planning Authority (BMICAPA) (the 2nd respondent herein). 6. The petitioner is therefore permitted to make an application seeking for grant of permission to erect a warehouse as requested by him in Annexure – H and if such an application is made, the same shall be considered in accordance with law and appropriate orders be passed. 7. It is also made clear that the contentions of the petitioner that no conversion would be required as held by the Division Bench of this Court in W.A.No.100124/2018, dated 22.10.2018 and also - 5 - NC: 2025:KHC:1583 WP No. 7617 of 2024 the judgments referred to in this writ petition shall have to be taken into consideration. 8.
