HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - A No. - 15097 of 2025 Court No. - 7 HON'BLE MANISH MATHUR, J. 1. Heard learned counsel for petitioner and Mr. Prafulla Kumar Srivastava, learned Counsel for opposite parties. 2. Petition has been filed seeking a direction to authority concerned to consider and decide petitioner's application for compassionate appointment in terms of Dying-in-Harness Rules in view of the fact that petitioner's father late Jokhan Ram Verma went missing on 14.05.2005 while in service with the opposite parties. 3. Learned counsel for opposite parties has raised a preliminary objection regarding maintainability of this petition before this Court at Lucknow in view of fact that petitioner's father admittedly was in service of opposite party No.2 at Delhi from where he went missing and directions are sought to the authorities who are outside the territorial jurisdiction of this Court at Delhi. 4. Upon consideration of submissions advanced by learned counsel for parties and perusal of material on record, it appears that even a part cause of action has not accrued within the territorial jurisdiction of this Court and therefore, petition is required to be filed before the Court having competent jurisdiction. 5. In view thereof, petition is dismissed as withdrawn granting liberty to petitioner to file a petition before the Court having competent jurisdiction.
