1. Applicant has filed this second bail application under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail as he has been arrested in connection with Crime No.512/2023, registered at Police Station – Tilda - Nevra, District – Raipur (C.G.) for offence punishable under Section 307 of I.P.C. and Section 25 & 27 of Arms Act.

Learned counsel for applicant submits that this bail application has been filed on the ground of delay in trial as the Investigating Officer is BALRAM PRASAD DEWANGAN Digitally signed by BALRAM PRASAD DEWANGAN Date: 2025.05.08 16:08:47 +0530
2 not turning up for recording of his evidence even after issuance of several summons and bailable warrant. She further submits that as per her information, now the Investigating Officer has been examined on 06.05.2025.
3. Upon asking learned counsel for parties fairly submits that as per their instructions, all enlisted witnesses have been examined before the trial Court and the next date is fixed for recording of statement of accused on 13.05.2025.
4. Considering the aforementioned facts of the case and further taking into consideration the fact that the case is already fixed for recording of statement of accused on 13.05.2025, I am not inclined to consider this bail application on merits. It is accordingly dismissed.
5. However, considering the fact that applicant is in jail since 02.11.2023, learned trial Court is directed to expedite the case and dispose of the trial at the earliest. Sd/- (Parth Prateem Sahu) Judge Balram
