HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 1348 of 2025 Court No. - 17 HON'BLE SUBHASH VIDYARTHI, J.
1. Heard Sri Anoop Kumar Upadhyay, the learned counsel for the applicant as well as Sri Mayank Sinha, the learned Additional Government Advocate appearing on behalf of the State and perused the records.
2. This second application has been filed by the applicant seeking anticipatory bail in F.I.R. bearing Case Crime No.04 of 2024, under Sections 394, 411, 413 I.P.C., registered at Police Station Kotwali Dehat, District Gonda. The first Anticipatory Bail Application No.2840 of 2024 was dismissed for want of prosecution on 17.09.2025 and this second application has been filed on 03.12.2025 and not promptly after rejection of the first anticipatory bail application.
3. The learned counsel for the applicant states that the applicant has been implicated in the present case on the basis of custodial statements of co- accused persons and two of those persons have already been granted bail.
4. In these circumstances, this court finds no good ground to grant pre-arrest bail to the applicant. The anticipatory bail application is accordingly rejected.
5. In case the applicant surrenders before the learned trial court and files an application for his release on bail, the same shall be considered and decided expeditiously in accordance with law, including the law laid down by the Hon'ble Supreme Court in Satender Kumar Antil v.
