CKR ASSOCIATES The Court made the following: 3 ORAL ORDER: Heard Sri K.V. Raghu Veer, learned Counsel for the Petitioners and Sri N. Sai Phanindra Kumar, learned Counsel appearing for the Respondents. 2. The present Civil Revision Petition is filed challenging the Order dated 08.11.2024 in C.M.A.No.4/2023 on the file of IV Additional District Judge, Ananthapuramu. The Suit bearing O.S.No.310/2020 is filed by the Revision Petitioners seeking Declaration and Permanent Injunction. Declaration is to the effect that there is no existing road/rasta in Sy.Nos.136, 145 & 146. The Petitioners/Plaintiffs secured an ad-interim temporary injunction in I.A.No.91/2020 in O.S.No.310/2020 vide Order dated 12.03.2020. The said ad-interim temporary injunction dated 12.03.2020 was later vacated on 02.02.2023. The Plaintiffs/Petitioners filed C.M.A.No.4/2023 on the file of the IV Additional District Judge, Ananthapuramu, assailing the Order passed in I.A.No.91/2020 dated 02.02.2023. Vide Order dated 08.11.2024, the learned IV Additional District Judge, Ananthapuramu was pleased to dismiss the C.M.A.No.4/2023 filed by the Plaintiffs/Petitioners herein. 3. This Court has perused the Order passed by the trial Court dated 02.02.2023 in I.A.No.91/2020. This Court has also perused the impugned Order dated 08.11.2024. Having considered the contents of paras 12 to 14 of the Order dated 08.11.2024 wherein, the learned IV Additional District Judge, Ananthapuramu, noted the appreciation of the Village Map (Ex.R1), photographs (Ex.R2) and the Google Map (Ex.R3), this Court is of the view that the findings rendered in both the Orders are just and reasonable under the facts and circumstances. 4. In this view of the matter, this Court is not inclined to interfere in the present Civil Revision Petition. Accordingly, this Civil Revision Petition is dismissed. No order as to costs. 4 5. Needless to state that the observations made in the ad-interim temporary injunction dated 02.02.2023 and in the impugned Order dated 08.11.2024 shall not have any bearing either on the final trial or on the merits of the Suit. 6.
