Standard Vaccum Oil Company, Delaware State Newyork, United States Of America, Branch Office- Parliament Street New Delhi 2. Hindustan Petroleum Corporation Limited, Registered Office- 17, Jamshed Ji Tata Road, Registered Office- Tel Bhawan Sahakar Marg, Jaipur, Rajasthan ----Respondents For Petitioner(s) : Mr. Mohit Khandelwal with Mr. Pranav Sharma JUSTICE ANOOP KUMAR DHAND Order 26/05/2025 1. By way of filing this writ petition, a prayer has been made for issuing directions to the Rent Tribunal, Jaipur Metropolitan II for expeditious disposal of the Eviction Petition No.741/2016 within time frame, i.e., six months. 2. Learned counsel for the petitioners submits that the petitioners filed an eviction petition under Section 9 of the [2025:RJ-JP:21964] (2 of 2) [CW-7963/2025] Rajasthan Rent Control Act, 2001 (hereinafter referred to as “the Act of 2001”) against the respondents in the year 2016. Learned counsel submits that the stage of the case is for cross- examination of the petitioners since 2018. Learned counsel submits that more than six years have passed, till date the petitioners have not been cross-examined by the respondents and the case is deferred for one date to another. Learned counsel submits that twice two different applications were filed by the respondents under Order 6 Rule 17 CPC and Rule 7 Order 11 CPC. Those applications remained pending for a period of almost two years and finally both these applications were rejected. Learned counsel submits that sole objection of the respondents is to delay the disposal of the pending eviction petition, hence under these circumstances, appropriate orders would be passed for expeditious disposal of the above eviction petition. 3. Considering the above limited prayer made by counsel for the petitioners and looking to the fact that eviction petition is lying pending before the Rent Tribunal, Jaipur Metropolitan II for the last nine years and till date the stage of the matter is for cross- examination of the petitioners by the respondents, the instant writ petition stands disposed of with a direction to the Tribunal to decide the eviction petition expeditiously as early as possible preferably within a period of 18 months from the date of receipt of certified copy of this order. 4. Stay application as well as all applications (pending, if any) also stand disposed of. (ANOOP KUMAR DHAND),J Karan/17
