Heard Mr. A. Paramanik learned counsel for the petitioners. Also heard Mr. P. Borthakur, learned Additional Public Prosecutor for the State of Assam. 2. This is an application filed under Section 483 of the BNSS, 2023 by the petitioners, Taizuddin Shekh and Ariful Shekh seeking regular bail in connection with Morigaon P. S. Case No.167/2025, under Sections331(4)/305 of the BNS, 2023, they are stated to be in pre-trial detention upon arrest since 11.08.2025. 3. Learned Additional Public Prosecutor submits that in the meantime, investigation has been completed in this case, resulting in Charge-Sheet against the accused persons. The allegation was pertaining to house trespass and theft. 4. Learned Additional Public Prosecutor opposes the bail application pointing out that there are more than one case pending against the accused person. 5. Nevertheless, considering the completion of investigation, I am of the considered opinion that the accused petitioners can be given a chance at liberty after imposing suitable conditions. 6. Accordingly, petitioners, Taizuddin Shekh and Ariful Shekh shall be allowed to go on bail bond of Rs.30,000/- each with one suitable surety of like amount to the satisfaction of the learned concerned Court. 7. The direction for bail is further subject to the condition(s) that the accused petitioner; i. Shall not abscond; ii. Shall not hamper or tamper with evidence; iii. Shall not try to influence any witnesses including the Page No.# 3/3 informant; and iv. Shall not misuse his liberty to commit any offence or illegal activities. 8. Violation or breach of condition(s) shall entail cancellation of the bail. 9. This bail application stands disposed of. JUDGE Comparing Assistant
