Heard learned counsel for petitioner and learned State Counsel appearing on behalf of the opposite parties. 2. Present petition under Article 226 of Constitution of India has been filed seeking the following main relief:- "ISSUE, a writ order or direction in the nature of MANDAMUS commanding the opposite parties to permit the petitioner to discharge his work on the post of seasonal collection peon in District Sultanpur and including his name in the seniority list of seasonal collection peon District Sultanpur taking in to consideration his initial appointment dated 05.05.1993 worked about (749 days) and also count his service period w.e.f. 19.05.2017 to 15.08.2017 worked as seasonal collection peon about (89 days) and place the petitioner at appropriate place in the seniority list of collection peon in the above said District in accordance with law." "ISSUE, a writ order or direction in the nature of MANDAMUS commanding the opposite parties to consider the case of the petitioner for regularization on the post of regular Collection Peon and till his regularization he may be permitted to work as seasonal collection peon in Tahsil- Sadar, District-Sultanpur, with all consequential benefit of service and pay to him regular salary in accordance with U.P. Collection Peons Service Rules" 3. Learned counsel for petitioner has laid emphasis on prayer no.2. Versus Counsel for Petitioner(s) : Anil Kumar Pandey Counsel for Respondent(s) : C.S.C. Siyaram .....Petitioner(s) State Of U.P. Thru. Addl. Chief Secy. Revenue Deptt. Lko. And 2 Others .....Respondent(s) 4. Since considering petitioner's grievance would entail factual aspects, liberty is granted to petitioner to file fresh representation before opposite party no.2 i.e. Collector, District Sultanpur. In case such a representation is filed, the same is required to be decided by authority concerned expeditiously by a reasoned and speaking order within a period of six weeks from receipt of representation of petitioner along with a certified copy of this order. 4.
