Neutral Citation No. - 2025:AHC:23909 Court No. - 5 Case :- WRIT - A No. - 2119 of 2025 Petitioner :- Tanu Kanaujiya Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Arvind Kumar Goswami,Ashwani Kumar Counsel for Respondent :- Anand Prakash Paul,C.S.C.,Pradeep Kumar Tripathi Hon'ble Ajay Bhanot,J. Heard Shri Arvind Kumar Goswami, learned counsel for the petitioner, learned Standing Counsel for the respondent No. 1-State and Shri Pradeep Kumar Tripathi,
learned counsel for the respondents No. 2 & 3. The petitioner claims that her case on compassionate ground appointment has not been considered. A representation in this regard has been made to the competent authority but to no avail. The only prayer made on behalf of the petitioner is that her representation may be decided within a stipulated period of time. Sri Pradeep Kumar Tripathi, learned counsel for the respondent nos. 2 and 3 submits that the matter requires factual determination including the financial status of the family and other considerations as per applicable laws and Government Orders by the competent authority in the first instance. However, he fairly contends that the purpose of appointment on compassionate ground will be defeated in
case the appointments are not processed in a reasonable period of time. In light of the submissions made at the Bar and without going into the merits of the case, the respondent no. 3 i.e. Vice Chairman, Kanpur Development Authority, Kanpur Nagar is directed to decide the representation of the petitioner for grant of appointment on compassionate ground as per law within a period of four months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally
disposed of.
