[2025:RJ-JP:23167] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 6293/2025 Ramchandra S/o Shri Ram Singh, Aged About 46 Years, R/o Rampura, Police Station Sewar, District Bharatpur (Raj.) (At Present Confined At Central Jail Bharatpur). Accused-Petitioner Versus The State of Rajasthan, through the Public Prosecutor ----Respondent For Petitioner(s) : Mr. Nikhlesh Katara For Respondent(s) : Mr. M.S. Shekhawat, P.P. Mr. Shree Ram Dhakar, P.P. HON'BLE MR. JUSTICE SAMEER JAIN Judgment 12/06/2025 1. The instant bail application has been filed under Section 483 B.N.S.S. on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No. 65/2025 dated 01.02.2025 registered at Police Station Mathuragate District Bharatpur for the offence(s) under Sections 316(2), 318(4) & 351(2) of B.N.S. 2. Learned counsel for the accused-applicant has submitted that the applicant is the sole bread earner of the family and only one criminal antecedent is registered against him. 3. Per contra, learned Public Prosecutor has vehemently opposed the bail application. 4. Having heard and considered the arguments advanced by the learned counsel for the parties and taking note of the fact that the accused-applicant is behind bars from 29.04.2025; that he is the [2025:RJ-JP:23167] (2 of 2) [CRLMB-6293/2025] sole bread earner of the family; that only one criminal antecedent is registered against the accused-applicant, that one cross-case is also registered against the accused-applicant, therefore, looking to the overall facts and circumstances of the case and material available on record but without commenting on merits/demerits of the case, this court is inclined to allow the bail application of the accused-applicant and enlarge him on bail. 5. Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that accused-applicant Ramchandra S/o Shri Ram Singh shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
