1. These instant bail applications have been filed under Section 483 of BNSS on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No. 18/2025 registered at Police Station Nai Mandi Hindaun District Karauli for the offence(s) under Section 127(2) and 309 (4) of BNS. 2. Learned counsels for the accused-petitioners submit that the accused-petitioners have falsely been implicated in this case. It is
[2025:RJ-JP:33271] (2 of 3) [CRLMB-6277/2025] contended that no identification parade was conducted by the police officials. The police official who identified the petitioner Ompraksh has stated in his statement recorded under Section 180 of the BNSS, that he identified the person on the basis of his nose, the said identification is questionable. It is also contended that petitioner Vishnu Kumar has been implicated solely on the basis of the information furnished by the petitioner Omprakash. It is also contended that co-accused Balram has already been enlarged on bail by co-ordinate Bench of this court vide order dated 10.06.2025 passed in SB criminal misc. bail application No. 6716/2025. At the instance of petitioner's recovery of robbed money was effected and petitioners' case is akin to the case of co- accused Balram, who has already been enlarged on bail. The accused-petitioner is in custody since 14.01.2025 and the trial of the case may take considerable time, therefore the present criminal misc. bail applications may be allowed. 3. Learned Public Prosecutor opposed the bail application and contended that petitioners committed robbery in the bank and robbed Rs. 10,75,100/- (ten lakh seventy five thousand one hundred). The recovery of Rs. 5,10,600/- and Rs. 95,000/- were made from both the petitioner. At the instance of petitioner Omprakash a fire arm was also recovered alongwith eleven cartridges.
Accused-petitioner Omprakash is a habitual offender and against him similar nature of one case was registered in police station Masalpur bearing FIR No. 150/2021, therefore, considering the above facts, these present bail applications deserves to be dismissed. 4. Heard and perused the material available on the record. [2025:RJ-JP:33271] (3 of 3) [CRLMB-6277/2025]
5. It is alleged against both the petitioners that they entered into a bank and committed robbery of Rs. 10,75,100/- and petitioners were arrested after four days of the said robbery i.e. on 14.01.2025. On the petitioner's information robbed money were recovered and at the instance of petitioner Omprakash a fire arm alongwith eleven cartridges were also recovered. The offences alleged against the petitioners are grave in nature and case of the other co-accused Balram is entirely different from the present petitioners, therefore, considering the above facts, this court is not inclined to enlarge the petitioners on bail. 6. Accordingly, the present criminal misc. bail applications are hereby dismissed. (PRAVEER BHATNAGAR),J ashu /30-31
