1. Heard Mr. HR Khan, learned counsel for the petitioner. 2. The present application is filed with the following prayer:
“It is, therefore, prayed that your Lordships would be kind enough to admit this petition, call for the records and issue Rule calling upon the respondents to show cause as to why a Writ of Mandamus/ certiorari should not be issued and on perusal of records and after hearing the parties, your Lordships may further be pleased to pass any other order or orders as your Lordships may deem fit and proper for the interest of justice. -And- As an interim measure your Lordships may further be pleased to pass a status quo order so that the schedule land as mentioned in the Agreement dated 15.11.2023 (Annexure I) shall not be handed over or sold to anybody else other than the petitioner for the ends of justice. 3. The petitioner made a statement at paragraph 9 to the following

“9.
That, the petitioner beg to state that this matter relates to civil nature and appropriate forum is the Civil Court to raise the claim under Specific Relief Act but honestly your humble petitioner submits that she will file a civil case in the appropriate court of law within a short span of time, but since the matter is very urgent as the petitioner is apprehended that her proposed purchase land may be handed over to third party and hence your humble petitioner seeks your Lordship indulgence to give a status quo order as in interim measure. 4. In the aforesaid backdrop and pleadings and facts, this court has expressed its opinion that this application is nothing but a frivolous application and therefore, liable to be dismissed with cost. 5. At this stage, Mr. Khan, learned counsel for the petitioner submits that he may be permitted to withdraw the present application, which this court initially was not inclined, however, the learned counsel for the petitioner submits that he will not file any such frivolous petition in future and therefore, he may be allowed to withdraw the writ petition. 6. Considering the above, the present writ petition stands dismissed on withdrawal. JUDGE Comparing Assistant
