A supplementary affidavit filed by the learned counsel for the petitioner is taken on record. 2. Heard Shri Raj Priya Srivastava, the learned counsel for the petitioner and Shri Ashutosh Srivastava, the learned Standing Counsel for the State of U.P. 3. By means of the instant petition, the petitioner has sought issuance of a writ of mandamus commanding the opposite parties, particularly the opposite party No.4- District Assistant Commissioner and Assistant Registrar Cooperative, District- Shrawasti, to not to establish a new cooperative society after bifurcating/division of B- PACS Lalbojha Darvesh Gaon, Block- Jamunaha, District- Shrawasti, without following the procedure prescribed under Section 16 of the Cooperative Societies Act. 4. On the basis of written instructions, the learned Standing Counsel has stated that the petitioner-Society is not being divided or bifurcated, rather a new society is being created in furtherance of a Government Order dated 06.04.2023. He has submitted that the provisions of Section 16 of the Cooperative Societies Act do not apply to creation of a new society, when the pre-existing Society is not being divided or bifurcated. 5. In view of the aforesaid statement made by the learned Standing Counsel on the basis of written instructions, a copy whereof is kept on record, the apprehension of the petitioner is unfounded. 6.
