The said crime was registered for the offences punishable under Sections 403, 406, 419, 420, 465, 466, 467, 468 & 471 IPC. 3. Case of the prosecution is that large scale of misappropriation of funds siphoned off from the Chief Minister Relief fund, which is functioning to assist poor people especially living below poverty line. A complaint was lodged by the Special Secretary to the Chief Minister stating a list of patients who had taken treatment in the hospital and received applications in CMRF section was sent for cross-verification to check their authenticity. Concerned hospital authorities have replied stating that the patients in 72 files have not received any treatment in their hospital. On a random verification of the files in question, it is noticed that the accused misappropriated funds and A.1 is the Kingpin for the fraud. It is further alleged that the petitioner also prepared fake and forged CMRF records with the help of A.1. The accused used to give Rs.3,000/- to A.1 for every fake CMRF relief bill she prepared. In that way, they prepared fake CMRF records with the help of A.1 and another. It is also alleged that the patients were not admitted to the hospital and were treated. It is further alleged that A.5 also prepared some fake CMRF bills with the help of A.1. 4. In view of the specific allegations made against the petitioner / A.5, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Petition is dismissed. However, the petitioner is at liberty to surrender himself before the trial court concerned and move for a regular bail and such being the case, the same can be dealt with by the trial court concerned in accordance with law, within one week thereafter. ____ K.SURESH REDDY, J Date: 27.03.2025 MVA
