The petitioner has been made accused in connection with Cyber (Deoghar) P.S. Case No.69 of 2025 registered under Section 319(2), 318(4), 338, 336(3), 340(2) & 61(2) of the B.N.S., 2023 and Section 66 B, 66 C, 66 D and 84 C of the Information Technology Act. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was involved in cybercrime and he has defrauded the victims Mayaben Gayakwad to the tune of Rs.7,045/-, Rahul Bhai to the tune of Rs.8,613/- and Kamla Bhanushalu to the tune of Rs.7,198/- and the petitioner has been implicated in this case, only on the basis of recovery of two mobile phones with two sim cards from his possession. It is submitted that the allegation against the petitioner is false. It is next submitted that the petitioner has no criminal antecedent as has been mentioned in para-14 of this bail application. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case and that he will transfer the respective amounts allegedly defrauded from the bank accounts of the said victims. It is lastly submitted that the petitioner has been in custody since 23.04.2025 as is evident from para-01 of the instant bail application. Hence it is submitted that the petitioner be released on bail. Learned Addl.P.P. opposes the prayer for bail. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on showing proof of transferring Rs.7,045/-, Rs.8,613 and Rs.7,198/- to the accounts of Mayaben Gayakwad, Rahul Bhai and Kamla Bhanushalu respectively and on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Deoghar in connection with Cyber (Deoghar) P.S. Case No.69 of 2025 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case.
