(Oral) CRM-7720-2025 The instant application has been filed for directing the parties especially respondent no.5 to record her fresh statement before the learned trial Court in compliance of order dated 31.01.2025 For the reasons stated in the application, application stands allowed. Report has been received from the learned Judicial Magistrate First Class, Ambala which reveals that statements of the petitioners, respondents no. 2 to 5 as well as investigating officer have been recorded. The photocopies of the same have been tagged with the report. It has also been revealed from the report that learned trial Court has recorded the statement of respondent no.5 after mentioning her correct name. CRM-M-5692-2025(O&M) 2 The present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 for quashing of FIR No.189 dated 18.04.2020 under Sections 323, 336, 34, 447, 448, 452, 506 of IPC registered at Police Station Ambala Sadar, District Ambala and all the subsequent proceedings arising therefrom, on the basis of compromise dated 17.12.2024 (Annexure P-2). 2 . This Court vide order dated 31.01.2025 had directed the parties to appear before the trial Court to get their statements recorded and the learned Magistrate was directed to send its report qua the genuineness of the compromise. 3. Pursuant to the aforesaid order, parties have appeared before the Judicial Magistrate First Class, Ambala and got their statements recorded. On the basis of the statements so recorded, learned Magistrate has submitted copy of report dated 13.03.2025 to the effect that the compromise has been effected between the parties voluntarily and without any coercion or undue influence. 4. Learned State counsel as well as counsel for respondent No.2 to 5 have not disputed the factum of compromise between the parties. 5. In view of the above, no useful purpose would be served to continue with the proceedings before the trial Court in the instant FIR. 6.
