Order 12/08/2025
1. The instant bail application has been filed under Section 483 of BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 277/2020 registered at Police Station Nihalganj, District Dholpur for the offences under Sections 143, 420, 406, 467, 468, 471 and 120-B of IPC.
2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that the offences alleged against the accused- petitioner are exclusively triable by Magistrate. The police after thorough investigation submitted charge-sheet against the
[2025:RJ-JP:31414] (2 of 3) [CRLMB-6302/2025] accused-petitioner for the offences under Sections 420, 406 and 120-B of IPC. It is contended that similar nature of FIR was registered against the petitioner by investor and the present FIR was registered by the agent of petitioner's company, who received the amount from the investor. It is further contended that out of total 38 cited witnesses only five witnesses have been examined till now. The maximum punishment under Section 420 is imprisonment which may extend to 7 years and the petitioner has suffered almost half of the punishment. The accused-petitioner is in custody since 07.12.2021 and the trial of the case may take considerable time, therefore, the bail application of the accused- petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail application and contended that against the present petitioner 13 other cases were registered of similar nature and also under Sections 420, 467, 468, 471, 406 and 120-B of IPC. The accused- petitioner is resident of Uttar Pradesh and if the bail application of the petitioner is allowed then there is possibility that the petitioner may abscond, therefore his bail application deserves to be dismissed. 4. Heard and perused the material available on record. 5. It is not desirable to express anything on the merits of the case, considering the period of incarceration and the fact that the conclusion of trial is not likely in near future and out of 38 cited witnesses only five have been examined till now. The offences alleged against the accused-petitioner are exclusively triable by Magistrate, the accused-petitioner is in custody since long and the trial of the case may take considerable time, without commenting
[2025:RJ-JP:31414] (3 of 3) [CRLMB-6302/2025] anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. 6.
Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Bhanu Pratap Singh S/o Shri Rajveer Singh, in connection with FIR No.277/2020 registered at Police Station Nihalganj, District Dholpur shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
