Even though the respondents have not filed reply to the writ petition, however, with the consent of learned counsel for the parties, matter is heard at this stage.

This petition has been filed for grant of following relief: -
“a. To issue a writ of mandamus, appropriate writ,
order or direction in nature thereof, directing the respondent department to treat the petitioners as having been appointed in the year 2002 with all

- 2 - consequential benefits for all purposes and intents.”

Relief has been prayed for on the strength of the decision rendered in Milat Ram and others Vs. State of H.P. and others2. Learned counsel for the petitioners submits that the petitioners would be content in case they are permitted to file representation(s) to the respondent/Competent Authority for redressal of their grievances and the respondents/Competent Authority is
directed to decide the same within a time bound schedule. Learned Assistant Advocate General has no objection to this prayer.

Having regard to above submissions but without examining the merits of the matter, this petition is disposed by permitting the petitioners to file representation(s) within two weeks, which shall be decided by the respondents /Competent Authority within six weeks from the date of receipt of the same, in accordance with law and also keeping in view the aforesaid judgment. The decision so arrived at, shall be communicated to the petitioners.
