Seen the office report dated 20.11.2025, based upon the letter of the Chief Judicial Magistrate, Hardoi dated 13.11.2025. According to the same the appellant No.2 - Hira Lal died on 23.11.2023 and appellant No.3 - Rameshwar died 15 days prior to the letter dated 13.11.2025. The relevant portion of the report is extracted herein under :- "As per report of P.S. Concerned, Appellant no. 2 Heeralal had died on 23-11-2023. A Certificate of Gram Pradhan is annexed for kind perusal. As per report of P.S. Concerned, Appellant no. 3 Rameshwar had died 15 days ago. A Certificate of Gram Pradhan is annexed for kind perusal. The above compliance report alongwith Bailable and Non Bailable Warrant are being sent to your goodself with the request to place it before Hon'ble Court." Taking note of the aforesaid, the present appeal stands abated for appellant No.2- Hiralal and appellant No.3 - Rameshwar. The appeal has already abated in regard to the appellant No.1-Ram Swarup, as is evident from the order dated 09.10.2025. Accordingly, the matter be consigned to record. The trial court record, if received, be transmitted to the trial court concerned along with a copy of this order.
