The present anticipatory bail application has been filed seeking anticipatory bail in Case Crime no. 243/2025, U/s-191(2), 191(3), 190, 351(3), 352, 333, 109, 117(2), Β.Ν.S. (147, 148, 149, 307, 506, 504, 452,325 I.P.C.) P.S. Fakharpur, District Bahraich. Heard learned counsel for the applicant as well as learned AGA for the State. Notice to respondent no. 2 is dispensed with in view of the proposed order. Learned counsel for the applicant submits that the applicant has been falsely implicated. It is argued that the injuries sustained by the injured, Siraju, are simple in nature and not grievous, and therefore, no offence under Section 109 BNS is made out. It is further contended that only general allegations have been levelled against the applicant. Learned AGA, on the basis of the case diary, opposes the anticipatory bail and submits that several persons have sustained injuries in the incident. Injured Khurshid has suffered a fracture, while another injured, Smt. Hashiman, has also sustained a fracture on her finger. The remaining injured have suffered simple injuries. Perused the record. And Another .....Opposite Party(s) application of the applicant, has recorded the following findings, which are reproduced herein below:– "के स डायरी एवं अęय सुसंगत Šपśȋ के पिरशीलन से Šकट होता है िक आवेदĆलगण/अिभयुǘगण के िवɳǪ अिभयोग है िक उęहȋने व सह-अिभयुǘगण ने अपने सामाęय उǩेģय के अŎसारण मȅ िविध िवɴǪ जमाव कायम करके मुकदमे की बात कु को लेकर घातक आयुध लोहे की राड, तलवार व हाकी से लैस होकर गािलयां देते ɷए खुरशेद को जान से मारने की िनयत से उसके घर मȅ घुसकर उसे भारने लगे, वादी व उसके साथ िसराजू, हसीमुन,, परमीन, सुहेल व आिदल बचाने के िलये गये, तो उęहȅ भी मारा-पीटा व जान से मारने की धमकी दी। अिभयोजन ना तकă है िक आवेदकगण /अिभयुǘगण Šथम सूचना िरपोटă मȅ नािमत हȈ। आवेदकगण / अिभयुǘगण घटना के बाद से ही फरार चल रहे हȈ और िववेचना मȅ कोई सहयोग नहȂ कर रहे हȈ। यिद आवेदकगण /अिभयुǘगण को अिŎम जमानत पर िरहा िकया गया तो उनके DZारा िववेचना मȅ सहयोग नहȂ िकया जायेगा, सािWयȋ को Šभािवत िकया जायेगा और उनके पíोसी राǸą नेपाल भाग जाने की Šबल सĞभावना है। के स डायरी के िविभęन पचȍ मȅ भी दौरान िववेचना िववेचक DZारा यह उिġलिखत िकया गया िक पुिलस DZारा आवेदकै गण/अिभयुǘगण के घर तथा िमलने वाले सĞभािवत ĥथानȋ पर दिबश दी गयी, िकęतु वे दĥतेयाब नहȂ ɷए। Šकरण मȅ अभी िववेचना Šचिलत है. तथा साĨय संकलन शेष है। ऐसी िĥथित मȅ आवेदकगण/अिभयुǘगण को धारा-482 बी०एन०एस०एस० का लाभ िदया जाना युिǘसंगत Šतीत नहȂ होता है।" Upon perusal of the record and the case diary produced by the learned AGA, it transpires that five persons were injured in the incident. Injured Khurshid has sustained a fracture in the lower end of the ulna bone of the left forearm. Injured Smt. Hashiman has also suffered a fracture on her finger and was advised an X-ray for the second injury. Statements of Dr. Asheesh Kumar Srivastava as well as the injured witnesses do not support the plea of false implication. Further, the case diary reflects that during the course of investigation and on examination of the injury report of injured Siraju Ahmad, Section 109 BNS has been omitted and Section 110 BNS has been added. Thus, the contention of false implication is not borne out from the record. No ground for grant of anticipatory bail is made out. Accordingly, the anticipatory bail application stands dismissed.
