Heard Sri Dharmendra Kumar, learned counsel for the petitioners and Sri Neel Padm Singh, learned Addl. Chief Standing Counsel. 2. The instant petition has been filed seeking direction to opposite party No.1 to decide the restoration application in Case No. 2724 of 2018, computerized no. T201804230302724 under Rule 34 of the U.P. Revenue Code, which is pending since 17.11.2023 within stipulated period. 3. Contention of learned counsel for the petitioners is that the application, filed by the mother of the petitioners, namely, Kamla Devi, under Section 34 of the U.P. Revenue Code, was dismissed on 17.11.2023. Thereafter, the mother of the petitioners filed a recall application dated 17.11.2023 and during pendency of the said application, the mother of the petitioners died on 24.6.2024 and after her death the present petitioners, being real daughters of Kamla Devi, filed substitution application. Therefore, the court below may be directed to decide the recall application, filed by mother of the petitioners on 17.11.2023 along with the substitution application filed by the petitioners. 4. Considering the aforesaid facts and circumstances of the case, the petition is disposed of with a direction to respondent No.1 to decide the recall/restoration application in Case No. 2724 of 2018 under Section 34 of the U.P. Revenue Code as expeditiously as possible in the light of directions issued by this Court in the judgement of Daya Shankar vs. State of U.P. and others, reported in 2023 (6) ADJ 181.
