Heard Sri Suresh Chandra Srivastava, learned counsel for the petitioner and Sri Yogesh Kumar Awasthi, learned Standing Counsel for the State. 2. Present petition has been filed for the following relief: "(1) direct the O.P. No. 2 i.e. Tehsildar, Tehsil - Amethi, District - Amethi to decide the case expeditiously within a certain time, under section 34 of the U.P. Revenue Code, 2006, Case No.2171/2024, Computerized Case No.T202404710502171, U/S 34 of U.P. Revenue Code - 2006, Ram Jiyavan vs. Chandrawati, is pending before Tehsildar, Tehsil - Amethi, District Amethi, based on the property of Late Smt. Chandrawati W/O Ram Jiyavan, in the interest of justice." 3. Contention of learned counsel for the petitioner is that respondent no.2 was directed to conclude the proceeding u/s 34 of U.P. Revenue Code, 2006 (in short 'the Code, 2006'), within time and as prescribed by the statute is 90 days but more than one year has passed and till date the application u/s 34 of the Code 2006 has not been decided. 4. Considering the aforesaid submission, present petition is disposed of with a direction to the respondent no.2 to conclude the proceeding of case no.2171 of 2024, u/s 34 of the Code, 2006, as expeditiously as possible, in light of the judgement of this court in Daya Shankar vs. State of U.P. and 4 others reported in 2023(6) ADJ 181, dated 19.05.2023.
