The applicant has filed this application to quash/stay the entire proceeding of criminal case no. 208/2024 (State of Uttar Pradesh Vs. Hari Shanker Gautam), arising out of F.I.R no. 919/2019, under Sections 419,420,467,468,471, of I.P.C, P.S. Kotwali Nagar, Sultanpur, pending before the court of the Chief Judicial Magistrate, Court No.17, Sultanpur, as also the cognizance and summoning order dated 15.02.2020 passed in the said case. Learned counsel for the applicant after arguing at length, submits that the applicant has already been granted bail in the present case. He also submits that the he does not want to press this application at this stage and wants to move discharge application before the court below. Learned A.G.A. has no objection to the prayer made by learned counsel for the applicant. In case the applicant moves application for discharge within 2 weeks from today, same will be decided by the court below within 4 weeks thereafter. Till six weeks from today or till the disposal of discharge-application, if moved, impugned proceedings shall remain stayed. With these observations/directions this application is disposed of.
