Neutral Citation No. - 2025:AHC:26526 Court No. - 4 Case :- WRIT - A No. - 1977 of 2025 Petitioner :- Raj Singh Respondent :- State of U.P. and Another Counsel for Petitioner :- Ghanshyam Pandey,Om Prakash Yadav Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents. Petitioner has prayed for following relief: (i) To issue a writ, order or writ of mandamus by commanding and directing the Respondents to fairly re-evaluate the OMR Answer sheet of the petitioner and declare successful in written examination of Constable Civil Police-2023 as the petitioner secured more marks/above to the cut-off marks in his category, which was held on 30.08.2024, in pursuance of Notification No.- PRPB-One(1)/150-REFP/2023. Learned Standing Counsel submits that there is no provision for re-evaluation of the OMR answer sheet, inasmuch as, petitioner has not been able to establish a case that the answers attempted by him are same in the master answer key. Even the copy of master answer key has not been filed. It is well settled principle of pleadings that even if a case has been pleaded it should support by the sufficient evidence, but petitioner has not been able to set up pleadings to demonstrate that there was some injustice done to him in evaluating and assessing his answer sheet. In the circumstances, this Court cannot issue a direction for decision upon the representation made by a candidate in such matters. Petition fails and is, accordingly, dismissed.
