The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.365 of 2025 pending on the file of learned S.D.J.M., Bhadrak, arising out of Bhadrak Rural P.S. Case No.65 of 2025 for commission of offence punishable under Sections 303(2)/ 317(2)/3(5) of BNS and Section 7 of the Orissa Prevention of Cow Slaughter Act and Section 11 of Prevention of Cruelty to Animals Act. 3. Taking into account the nature of allegations and the highest punishment prescribed under Section 303(2) of BNS is 5 years and that the Petitioner has no criminal proclivity, this Court has no iota of doubt that the authority shall scrupulously follow the guidelines laid down by the Apex Court in the case of Arnesh Kumar vrs. State of Bihar & another, (2014) 8 SCC 273 and reiterated in the case of Satender Kumar Antil vrs. Central Bureau of Investigation & another, (2022) 10 SCC 51. 4.
