The instant writ application has been preferred for the following relief:- (i) For quashing of the proceedings of the District Education Establishment committee, Sahebganj. dated 2025:JHHC:28462 2 31-01-2017, by which petitioner's candidature has been rejected on the ground that certificate of teachers training obtained by the petitioners are of two different sessions, though as per the verification report dated 04- 08-2016 supplied by West Bengal Board of Primary Education in pursuant to letter dated 1066 issued from the office of D.S.E. Sahebganj, teachers training certificate of the petitioners are correct and found in order and also in contravention of notification no. 532/BPE/2010 dated 31/05/2010 issued from West Bengal Board of Primary Education. (ii) Direction to respondents to issue joining letter in favour of the petitioners as petitioners were called for counseling after scrutinizing the relevant certificates and subsequently petitioners submitted all the required document before counseling board as demanded and documents were found correct by the board. 2. Learned counsel for the NCTE referred to its supplementary affidavit dated 26.7.2024 wherein in paragraph 3 (i), it has been stated as under:- 3. (i) “It is submitted that NCTE vide letter F.NO. 62- 5/2008/NCTE/N&S/11531 dated 05.03.2010 conveyed the approval of the competent authority to the Government of West Bengal for the proposed 'Bridge Course' in order to resolve the problem consequent upon the judgement of the Hon'ble Division Bench of Calcutta High Court in the matter of Tulsi Bakshi and others, wherein the qualifications given for one year PTT course being offered by various teacher training institutions in the State of West Bengal were not considered equivalent to the D.Ed. course in the absence of NCTEs recognition to the course.” 3. In crux, the NCTE has given clear finding that one year Bridge Course of the West Bengal Board of Primary Education was recognized. Therefore, the stand taken by the establishment committee, which is 2025:JHHC:28462 3 impugned, (Annexure-9) does not have any stand in the eye of law. Therefore, this Court holds that the Bridge Course Certificate of one year is valid and the Petitioners can get benefit of that certificate along with the other one-year certificate for his future examination. But due to afflux of time of seven years, when the entire appointment process has been completed, and now even the post has been converted into Sahayak Acharya, no relief can be granted to these Petitioners. 4.
