Heard learned counsel for petitioner and learned state counsel for opposite parties. 2. Petition has been filed seeking following prayers:- "i. Issue a writ, order or direction in the nature of mandamus commanding the Opposite Parties to consider the case of the petitioner for regularization of his services on the post of Mali on which he is working since August, 1998 under the provisions of U.P. Regularization of Persons working on daily wages or on work charge or on contract in Government Departments on Group C and Group D Posts (outside the purview of the U.P. Public Service Commission) Rules, 2016 and regularize his services accordingly at the earliest. ii. Issue a writ, order or direction in the nature of mandamus commanding the Opposite Parties to make payment of salary to the petitioner in the minimum of the pay scale admissible to the regular employees of the department holding the post of Mali as revised from time to time till the services of the petitioner are regularized." 3. Since petitioner's grievances would require consideration of factual aspects, liberty is granted to petitioner to make a fresh representation before opposite party No. 2 i.e. Director, Horticulture & Food Processing, U.P., Lucknow. In case such a representation is filed, the same is required to be decided in the light of Sabha Shankar Dube v. Divisional Forest Officer reported in AIR 2019 SC 220 in case same is applicable, within a period of six weeks from the date a certified copy of this order is produced before the said authority. 4.
