…...... 02/ 09.07.2025: Heard, learned counsel for the petitioners and learned counsel for the State. 2. This anticipatory bail application under Sections 482 and 484 of the Bhartiya Nagrik Surksha Sanhita, 2023, has been preferred by the petitioners apprehending their arrest for offences under Sections 33(i)(a) of Indian Forest Act, Section 5/14 of Bihar Saw Mill Regulation Act and Section 4 of J.K.V. Adhiniyam. 3. It is alleged that the petitioners in clandestine manner running sawmill in the forest area. 4. Admittedly, cognizance has already been taken in this case. Now it is these petitioners who has to ensure that they face trial without any delay, thus, I feel that this is a fit case for grant of anticipatory bail of the petitioner. 5. Accordingly, this Anticipatory Bail Application stands allowed. The petitioners, above named, are directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of their surrender or arrest, they shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each, to the satisfaction of learned S.D.J.M., Giridih, in connection with Complaint Case No.444 of 2021, subject to the
condition that one of the bailers should be a close relative of the petitioners and other should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which he is having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property. 6. Petitioners are directed to appear before the Court concerned and file their bail bonds to satisfaction of the Court concerned.
Further, petitioners should file an affidavit that they will appear before the Court concerned as and when directed failing which, it will be open to the Court concerned, to cancel the bail of these petitioners. (ANANDA SEN, J.) R.S./
