[2025:RJ-JP:20953] (3 of 4) [CW-7548/2025] HON'BLE MR. JUSTICE SUDESH BANSAL Order 19/05/2025
1. Instant writ petitions under Article 226 of the Constitution of India have been filed by petitioners, raising a grievance for not granting benefit of bonus marks for their working experience, to consider their candidature on merits for the post of Junior Instructor, pursuant to advertisement No.09/2024 notified on
11.03.2024. 2. Counsel for the petitioners during the course of arguments admits that the direct recruitment for the post of Junior Instructor in different trades through advertisement dated 11.03.2024 is being ensued under the Rajasthan Technical Training Subordinate Service Rules, 1975.
In such rules, provision for awarding bonus marks on the basis of working experience is not provided. 3. Counsel for the petitioner submits that government is providing bonus marks on the basis of their working experience in the recruitment of government employees under the Rajasthan Medical & Health Sub-ordinate Service Rules, 1965 on the post of Nursing Officer and Pharmacist and Rajasthan Panchayati Raj Rules, 1996 for the post of Lower Division Clerk etc. and under Rule 19 of Rajasthan Ayurvedic, Unani, Homoeopathy and Naturopathy Service Rules, 1973 for the post of Nurse Compounder Junior Grade. 4. Counsel for the petitioners submits that in the original statutory rules, the provision for granting benefit of bonus marks was not available and because of judicial indulgence, rules have been amended and the benefit of bonus marks have been provided to other posts. [2025:RJ-JP:20953] (4 of 4) [CW-7548/2025]
5. On that count, counsel for the petitioners, having instructions from the petitioners, seeks permission to withdraw both the writ petitions with liberty to file a fresh writ petition before the Division Bench, seeking amendment in the statutory rules of 1975, to insert the provisions for grant of bonus marks. 6. Accordingly, both the writ petitions are dismissed as withdrawn with liberty prayed for. 7. Stay applications and any other pending application, if any, also stand disposed of.
