ORAL ORDER
1. The petitioner challenges the order passed by the Trial Court taking cognizance of offences punishable under Sections 19(1), (2), (3), (4), and (5) of the Karnataka Private Medical Establishments Act, 2007 (for short, ‘Act, 2007’) and Sections 419 and 420 of the IPC.

2. Respondent No.4, the In-charge Taluk Health Officer, filed a private complaint before the learned Magistrate under Section 200 read with Section 156(3) of the Cr.P.C., stating that the petitioner is practicing medicine and operating a clinic without the requisite qualifications and without obtaining a license from the competent authority, in contravention of the K.P.M.E. Act,
2007.
3. The learned Magistrate, after perusing the complaint, took cognizance of the aforesaid offences, permitting the petitioner to approach this Court.
4. Heard the learned counsel for the petitioner and the learned High Court Government Pleader for the respondents.
5. Section 19A of the Act, 2007 states that no court shall take cognizance of an offence under this Act except on a written complaint by the Registration and Grievance Redressal Authority or any officer authorized in this behalf by the Registration and Grievance Redressal Authority. In the present case, the complaint was not filed by the Registration and Grievance Redressal Authority, nor was Respondent No.4 authorized by the Redressal Authority. Therefore, the cognizance taken of the aforesaid offences based on the complaint filed by Respondent No.4

lacks authority. In such circumstances, the continuation of criminal proceedings would amount to an abuse of the process of law.
6. Accordingly, the petition is allowed. The impugned proceedings in CC No.1817/2024 pending on the file of the learned Principal Civil Judge and JMFC Court at Bangarpet, is hereby quashed.
