Vakar Khan, learned counsel for the petitioners, Sri Sanjeev Shukla, advocate holding brief of Sri Mohan Singh, learned counsel for the gaon sabha and Sri Yogesh Kr. Awasthi, learned Standing Counsel for the State. 2. The instant petition has been filed to direct the opposite party No.2 i.e. Assistant Collector, Tehsil - Tanda, District Ambedkar Nagar to decide the interim injunction application filed in suit for partition bearing Suit No. T20244040301936 filed under Section 116 of U.P. Revenue Code pending since 12.9.2022 within stipulated time. 3. Contention of learned counsel for the petitioners is that petitioner's application for interim injunction in partition suit under Section 116 of the U.P. Revenue Code has been pending since 12.9.2022, therefore, the same may be directed to be decided in a time bound manner. 4. In view of the aforesaid facts and circumstances of the case, the petition is disposed of with a direction to respondent No.2 to decide the interim injunction application of the petitioner in partition suit dated 12.9.2022, under Section 116 of the U.P. Revenue Code, in terms of directions issued by this Court in paragraphs No. 13 and 16 of Daya Shankar vs. State of U.P. and others, reported in 2023 (6) ADJ 181 .
