HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - A No. - 10080 of 2025 Court No. - 18 HON'BLE SHREE PRAKASH SINGH, J. Since, the matter is being decided at the admission stage, therefore, notice to opposite party no. 8 is hereby dispensed with. Heard Sri Sharad Pathak, learned Senior Counsel assisted by Ms. Priya Singh, learned counsel for the petitioners, Dr. Udai Veer Singh, learned counsel for the opposite parties no. 1 to 7 and perused the record. The present writ petition has been filed assailing the order dated 30-01-2024, whereby the claim of the husband of the petitioner no. 3 for regularization of the services, has been rejected. Contention of learned counsel for the petitioners is that the order impugned has been passed prior to the Judgment and Order dated 30-09-2024 passed in Writ A No. 21492 of 2023, Vinod Kumar Srivastava Vs State of U.P. and Others alongwith other connected writ petitions, wherein certain guidelines and instructions have been made by the court. He further submitted that after the aforesaid Judgment and Order, the State Government has issued the government order on 04-10-2024 with certain directions. He added that since the order has been passed prior to 30-09-2024 therefore, the instructions and guidelines issued in the aforesaid Judgment and Order as well as the government order dated 04-10-2024,have not been considered. He further submitted that the interest of justice would be sub-served if this Hon'ble Court may be pleased to direct the authority concerned to reconsider Versus Counsel for Petitioner(s) : Sharad Pathak, Priya Singh Counsel for Respondent(s) : C.S.C. Anjnesh Singh And 2 Others .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Secondary Edu. Lko. And 7 Others .....Respondent(s)
the matter in the light of the Judgment and Order passed in the case of Vinod Kumar Srivastava(Supra) as well as the government order dated 04-10-2024, while quashing the order impugned dated 30-01-2024. Learned counsel appearing for the State though has opposed the contentions aforesaid and submitted that the matter has exhaustively been considered by the authority concerned/Regional Level Committee, but, he has failed to substantiate his argument that the same has been considered in the light of the guidelines laid in the case of Vinod Kumar Srivastava(Supra) as well as the government order dated 04-10-2024.
Upon considering the submissions of learned counsels for the parties and after perusal of records, it is apparent that the order impugned has been passed on 30-01-2024 i.e. prior to the Judgment and Order passed in the case of Vinod Kumar Srivastava(Supra) as well as the government order dated 04-10-2024. This court finds that there is no legal impediment, if the authority concerned/Regional Level Committee, reconsiders the matter for regularization of the services of the husband of the petitioner no. 3. Consequently, the order impugned dated 30-01-2024, is hereby quashed. The matter is remitted back to the Regional Level Committee to take a fresh decision for regularization of the services of the husband of the petitioner no. 3 in the light of the Judgment and Order passed in the case of Vinod Kumar Srivastava(Supra) as well as the government order dated 04-10-2024, within the period of three months, from the date a certified copy of this order is produced before him. It is further provided that all the issues are opened for consideration. With the aforesaid observations, the present writ petition is disposed of.
