Heard learned counsel for the petitioner, learned Additional Chief Standing Counsel for the State, Mr. Ratnesh Chandra, learned counsel for respondent no. 4 and perused the record. Instant petition has been filed with the following main prayer:- " 1. Issue a writ, order, or direction in the nature of mandamus commanding to opposite party no. 2 and 3, 4 to make the payment of entire post retiral dues of the petitioner's husband and to grant family pension to the petitioner in terms of the family settlement as contained in Annexure No. 5 to this writ petition." After arguing at length, learned counsel for the petitioner submits that the interest of justice would be sub-served if this Hon'ble Court may be pleased to give liberty to the petitioner to move a fresh representation before the respondent nos. 2 & 3 and they may be directed to consider & decide the same, within stipulated period of time as may be fixed by this Court. Learned counsel for the opposite parties have no objection to the contention aforesaid. Be that as it may, without entering into the merit of the case, the petitioner is permitted to move a fresh representation within period of 15 days, and if such representation is moved within aforesaid period, the respondent nos. 2/Vice-Chairman, Firozabad Shikohabad Development Authority & respondent no. 3/Secretary, Firozabad Shikohabad Development Authority, are hereby directed to consider Versus Counsel for Petitioner(s) : Satish Singh, Himanshu Singh Counsel for Respondent(s) : C.S.C., Mukesh Dhar Dwivedi, Ratnesh Chandra Alka Awasthi .....Petitioner(s) State Of U.P.
