Notice was issued to the appellant in view of the death of his counsel. 3. As per the office report notice is returned unserved and as per the postal endorsement there was insufficient address ‘for want of door number’. 4. A perusal of the notice sent with the registered acknowledgment shows that the same was sent to the address as was mentioned in the appeal filed by the appellant. 5. There is no representation on either side. 6. The matter pertains to year 2007 and is listed in the weekly cause-list. 7. In view of the above, the Civil Miscellaneous Appeal is closed. However, granting liberty to the appellant to file the recall petition of this order, if so desired, within a reasonable period. No order as to costs.
