It is, therefore, prayed that this Hon’ble Court may kindly be pleased to allow this petition and quash the Entire Charge-sheet pending in learned Judicial Magistrate First Class Rajnandgaon, Criminal Case No.9793/2024 along with FIR numbered 488/2024 of police station Lalbagh Rajnandgaon (C.G.) and cognizes order- sheet dated 19-12-2024. B. That this Hon’ble court may kindly be pleased to call for the entire records pertaining to the case of the petitioner. C. This Hon’ble court may kindly be pleased to direct the appropriate authority to initiate a criminal case against the respondent no.2 in accordance with law. D. That, this Hon’ble Court may kindly be pleased to grant any other relief, as it may deem fit.” 3. On perusal of the prayers in the present petition, it transpires that the present petition is drafted with the prayers which are defective one as there is no challenge of order taking cognizance, therefore, we are not inclined to entertain the present petition with such a vague and sketchy prayers, to which learned counsel for the petitioner seeks permission of this Court to withdraw the present petition with a liberty to file afresh with proper prayers. 3 4. Learned State counsel has no objection. 5. Accordingly the present petition is dismissed as withdrawn on the aforesaid liberty, as prayed for subject to depositing a sum of Rs.2,000/- as cost by the petitioner in the Registry of this Court and submit a receipt of the same at the time of filing of the fresh petition, if any, and the amount so deposited, if any, shall be transmitted to the Government Children’s Home for Orthopedically Handicapped, Mana Camp, Raipur, Chhattisgarh. 6. Certified copy of the FIR along with the Charge-sheet as well as all the order-sheets vide Annexure P/1, a copy of the written complaint vide Annexure P/2, a copy of the judgment along with all annexures dated 04.12.2024 vide Annexure P/3 and a claim petition (MACP) No.69/2025 pending in the Court of learned First Additional Claims Tribunal, Rajnandgaon vide Annexure P/4, shall be returned to the petitioner after obtaining photostate copies of the same.
