THOTA SUNEETHA The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a writ order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of 3rd respondent in granting police protection to the petitioner by considering his representation dated 14.02.2020 to prevent the breach of peace by taking necessary action against the persons disobey the court orders such as injunction as illegal arbitrary and violative of Articles 14 and 21 of the Constitution of India and consequently direct the respondents to give police protection to the petitioner” 2. Learned counsel for the petitioner would submit that the unofficial respondents initially filed a civil suit and also a petition seeking a temporary injunction, which was dismissed, with a finding in favour of the petitioner that they have title and possession over the subject property. Thereafter, the petitioner filed a civil suit in O.S. No. 87 of 2020 and obtained an ad-interim injunction, which has been extended from time to time. Both civil suits are pending before the trial Court and are coming up for trial. Learned counsel further would submit that a representation has been submitted to the police seeking police protection. 3. Sri Md.Farooq, learned Assistant Government Pleader for Home would submit that the matter is purely civil in nature and that the civil suits are 3 pending before the Court. In such circumstances, unless there is a judicial order, no police protection can be provided. 4. In that view, the Writ Petition is disposed of. However, the petitioner is at liberty to raise such contentions before the Court, where the civil suits filed by both parties are pending, and to work out his remedies in accordance with law. There shall be no order as to costs.
