The instant application has been filed seeking following main relief(s):- "That for the facts, reasons and circumstances stated in the accompanying affidavit, it is most respectfully prayed that this Hon'ble Court may graciously be pleased to quashed/set aside the Impugned Charge Sheet No. 216 of 2013 dated 25.09.2013 arising out of First Information Report No. 0275 of 2013, under section-452, 354(Ka)(V) 306 of Indian Penal Code Police Station-Mall, District-Lucknow, and entire criminal proceeding of Session Trial No. 523 of 2017 (State Versus Guddu alias Sandeep) registered against petitioner on the basis aforesaid impugned charge sheet, pending before Learned Additional District and Sessions Judge, Court No.6, Lucknow, on the basis of compromise, as continuation of the same would tantamount to gross abuse of the process of law resulting in a grave miscarriage of justice, which is contained as Annexure No. 1&2 to this petition. It is further prayed that this Hon'ble Court may kindly be pleased to stay the proceeding of Session Trial No. 523 of 2017 (State Versus Guddu alias Sandeep) pending before Learned Additional District and Sessions Judge, Court No.6, Lucknow, during the pendency of the present case." 3. After arguing the matter at some length, the learned counsel for the applicant prays for withdrawal of this application with liberty to the applicant to file afresh. 4. The aforesaid has not been opposed. 5. In view of the above, the instant application is dismissed as withdrawn with liberty, as prayed for. 6. Office is directed to return certified/original copies of the documents, if any, annexed with this application to the learned counsel for the applicant as per Rules in this regard.
