HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. WRIT PETITION No. - 10987 of 2025 Court No. - 11 HON'BLE ABDUL MOIN, J.
HON'BLE MRS. BABITA RANI, J. .
1. Heard learned counsel for the petitioners as well as learned A.G.A. appearing on behalf of respondent No. 1 to 3.
2. No notice is being issued to the respondents No.4 to 6 taking into consideration the nature of order proposed to be passed.
3. The petitioners have come before this court contending that they are in live-in relationship with each other yet the private respondents are harassing them.
4. However, learned counsel for the petitioners fairly states that the petitioner No.1 is a married lady and has not obtained a divorce from her husband.
5. The argument of learned counsel for the petitioners is that both the petitioners are major and they are in live-in relationship on their own volition. Even though, the petitioner No.1 might not have obtained a divorce from her husband, yet once the petitioners No.1 and 2 are living together, consequently, there cannot be any occasion for the private respondents and official respondents to harass the petitioners. Learned counsel has further states that no First Information Report has been registered against the petitioners in this regard.
6. Considering the aforesaid, the writ petition is disposed of leaving it open for the petitioners to file an application before the respondent No.2 i.e. Superintendent of Police, District Bahraich to raise their grievances Versus Counsel for Petitioner(s) : Ravindra Kumar Verma, Aiyyaz Mansuri Counsel for Respondent(s) : G.A. Pooja And Another .....Petitioner(s) State Of U.P. Thru. Secy. Home Civil Sectt. Lko. And Others .....Respondent(s)
pertaining to peaceful living. In case, an application is filed, the respondent No.2 shall consider the said application, expeditiously in accordance with law.
