By way of this petition, the petitioner has sought the following relief(s):- “10.1 That this Hon’ble Court may kindly be pleased to quash impugned orders (Annexure P-1) and (Annexure P-2) and to direct the respondent authorities to consider and grant compassionate appointment as it has been granted to legal heirs of similarly situated deceased employee Tenguram, within stipulated time, in the interest of justice. 10.2 Any other relief which may be suitable in the facts and circumstances of the case, may also be granted.” 2. It is pleaded that the father of the petitioner namely, Sevakram Yadav, who was working on collectorate rate under respondent No. 2. It is also pleaded that his services were regularized under work charge contingency paid SIDDHANT TAMRAKAR Digitally signed by SIDDHANT TAMRAKAR Date: 2025.09.09 14:07:47 +0530 2 establishment, died in harness on 23.06.2005. It is further pleaded that mother of the petitioner applied for compassionate appointment on 25.07.2005 and her application was rejected vide order dated 19.02.2007. The petitioner moved an application for grant of compassionate appointment on 02.12.2020 and same was rejected by respondent No. 2 vide order dated 06.07.2021 on the ground that earlier application moved by the mother of the petitioner was rejected in the year 2007, therefore, subsequent application moved by the son of the government servant is not maintainable. 3. Mr. Shubham Bajpayee, Panel Lawyer appearing for the State would submit that after death of Sevakram Yadav, who was working on the post of Cook, mother of the petitioner moved an application for grant of compassionate appointment and same was rejected vide order dated 19.02.2007 and that order attained finality, and after 13 years, the petitioner moved an application for grant of compassionate appointment on 02.12.2020. He would further submit that the petitioner failed to explain the delay part, and therefore, the petition deserves to be dismissed. 4. Heard. 5. Earlier application for grant of compassionate appointment was moved by mother of the petitioner, which was rejected vide order dated 19.02.2007, and after 13 years, the petitioner moved application on 02.12.2020 and same was rejected by respondent No. 2 vide order dated 06.07.2021 on the ground that earlier application moved by mother of the petitioner for grant of compassionate appointment was rejected vide order dated 19.02.2007, and the same attained finality. 6. Considering the fact that the petitioner moved an application for compassionate appointment after 15 years from date of death of his father 3 and he also failed to challenge earlier rejection order passed on application moved by his mother dated 20.02.2007 and also considering the fact that the petitioner has survived for long 20 years, I am not inclined to interfere with the order impugned. 7.
