GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus, declaring the action of the 3rd respondent to insist the petitioner presence before him on 16-09-2020 at 4.00 pm or any other date pursuant to the notice under Section 41 A of Cr.P.C., issued on 16-09-2020 itself in 2 connection with Crime no.435 of 2020 said to have been filed by the 4th respondent herein is illegal, arbitrary, colourable exercise of the power, abuse of process of law, apart from in utter violation of Art.I4 and 21 of the constitution of India, and also contrary to the Law of the Land in the matter of Arnesh Kumar Vs State of Bihar and another and consequently direct the 3rd respondent to differ the appearance of the petitioner before him on 16.09-2020 or any other dale for a period of 3 weeks on health wounds and Cnvid-19 pandemic by directing the 3rd respondent to supply the written version of the complaint and FIR in Crime no.435 of 2020 on file of the Kotha peta PS, Guntur Urban, Guntur.” 2. When the matter is taken up for hearing, Sri V.Farooq learned Assistant Government Pleader for Home would submit that the matter is compromised between the parties before Lok Adalat and as such, Crime No.435 of 2020 on the file of Kothapeta Police Station, has been closed. Hence, no further orders are required in this matter as the relief sought has become infructuous. 3. Sri V.V.N.Narayana Rao, learned counsel for the Petitioner would submit that the Court may pass appropriate orders. 4. Considering the submissions made, the Writ Petition is dismissed as the relief has become infructuous. There shall be no order as to costs.
