HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 12115 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J. 1. Heard learned counsel for the applicant, learned AGA and perused the record. 2. The applicant seeks enlargement on bail in FIR No. 466 of 2023, under sections 306 IPC, P.S. Purwa, District Unnao. 3. Learned counsel for the applicant argues that in terms of FIR it was alleged that sister in law of the informant aged about 19 years was enticed by the applicant. Subsequently he left her and once again enticed her and thereafter her phone was found to be switched off. Subsequently sister in law was found dead. The post mortem report indicate the cause of death as not ascertained. The applicant is being prosecuted for offences under Section 306 IPC. Even the FSL report is not conclusive and no poison was found. Considering that no cause of death was ascertained prima facie abetment at the instance of the applicant for prosecution under Section 306 IPC is apparently missing. 4. Learned AGA has opposed the bail application. 5. Considering the facts and circumstances and the law laid down by Hon'ble Supreme Court in the case of Mariano Anto Bruno and Anr vs Inspector of Police, 2022 SCC Online SC 1387, however, without commenting upon the merits of the case, the applicant who is in jail since 28.10.2025 and has no criminal history is entitled to be enlarged on bail.
