3. The applicant – Vishaluddin, who is in judicial custody in connection with FIR/Case Crime No. 312 of 2025, under Sections 303(2), 318(4), 336(2), 336(3), 340(2), 317(2) and 3(5) of BNS, registered at P.S.- Sitarganj, District Udham Singh Nagar, has sought his release on bail.
4. Heard learned counsel for the parties and perused the records.

Learned counsel for the applicant would submit that the alleged motorcycle was alleged to have been recovered from the co-accused Salman and the applicant was only the pillion rider of that motorcycle. After recovery, FIR was lodged on 17.09.2025 at Police Station-Sitarganj, District Udham Singh Nagar, being FIR/Case Crime No. 312 of 2025, under Sections 303(2), 318(4), 336(2), 336(3), 340(2), 317(2) and 3(5) of BNS.
6. It is further submitted by learned counsel for the applicant that the alleged motorcycle was recovered by the Police at Pilibhit on 16.09.2025 at about 10:30, and then on the next date, FIR of the same motorcycle was lodged at Police Station- Sitarganj, District Udham Singh Nagar at
16:31 hours.
7. Learned State Counsel, on the other hand, has vehemently opposed the bail application.

Having considered the submissions, under the facts and circumstances of the case and also considering the fact that applicant and the co-accused have already been granted bail for the self same offence registered at Police Station – Kotwali, District Pilibhit, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.
9. Accordingly, the bail application is allowed.
10. Let the applicant be released on bail on his executing a personal bond and furnishing two reliable sureties each of the like amount, to the satisfaction of the court concerned.
