HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 10687 of 2025 Court No. - 5 HON'BLE ALOK MATHUR, J. 1. Heard Shri Avneesh Singh, learned counsel for the petitioner as well as learned Standing Counsel for the respondents no. 1 to 4 and Shri Mohan Singh, learned counsel for respondent no.5. 2. In light of the order proposed to be passed, notice to respondents no. 6 and 7, is dispensed with. 3. In the present petition, the petitioner has challenged the order 02.08.3035, passed by the S.D.M., Tehsil Lambhuwa, District Sultanpur in exercise of power under Section 24 of the U.P. Revenue Code, wherein he has rejected the recall application, preferred by the petitioner. 4. In the writ petition, the petitioner has himself admitted that he has already preferred an appeal, which is pending before opposite party no.3. i.e. the Additional Commissioner (Judicial), Ayodhya Division, Ayodhya. Accordingly the impugned order is already subject matter of an appeal preferred by the petitioner on the same ground for the same relief, the writ petition under Article 226 of the Constitution of India would not be maintainable. 5. For the reasons above, no interference is required, the petition is accordingly, dismissed.
