GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the inaction on the part of the respondents No.2 to 4 in registering the crime on the complaint, dated 23- 04- 2024 submitted by petitioner against the respondents No.5 to 9 as arbitrary, illegal, abdication of the statutory duty cast on them and voilative of the fundamental rights guaranteed to petitioner under Articles 14, 19 and 21 of the Constitution of India and consequently direct the respondent No. 2 to 4 to register a crime against the respondents No.5 to 9 basing on the complaint, dated 23-04-2024 submitted by petitioner.” 2. Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, based on the complaint given by Respondent No.6, a case in Crime No.61 of 2024 on the file of Panjani Police Station for the offences under Sections 447, 427, 323, 506 and 509 read with 34 IPC has been registered against the Petitioner and three others. Police after detailed investigation filed charge sheet therein on the file of the Court of Judicial First Class Magistrate, Punganur which was numbered as C.C.No.234 of 2024. It is further submitted that there are civil disputes between the Petitioner and the unofficial Respondents. Learned Assistant Government Pleader would further submit that, on receipt of representation dated 23.04.2024 from the Petitioner, on enquiry, Police having found that the allegations mentioned therein are false, have not registered the case. 3. Ms.S.Parineeta, learned counsel for the Petitioner would submit that the Court may pass appropriate orders. 3 4. Considering the submissions made, the Writ Petition is disposed of giving liberty to the Petitioner to work out her remedies before appropriate forum in accordance with law. There shall be no order as to costs.
